Defendant specially excepts to the following allegations contained in the opening paragraph of plaintiffs' original petition:
“.... They further complain jointly and severally of agents of the state of Texas, and their successors in office herein after styled defendant-agents....”
The grounds of this exception are that the alleged agents of the state of Texas have not been named, no citation has been served on them, and they have not properly been made parties to this cause.

Defendant specially excepts to the following allegations which are set forth as the third unnumbered paragraph at the beginning of plaintiffs’ original petition:
Plaintiffs’ were trying to state that the laws of the state and the U.S. Government are here to protect them and that if they’re rights were not protected in due course that they should be afforded their constitutional right to appeal. At least that’s why I think they were trying to say, as I summarized a very, very long paragraph.
The grounds of this exception are that such allegations are vague and unintelligible and are immaterial to any cause of action stated by plaintiffs.

Me:
Technically another boring point. Yes, the families' attorneys should have known better. They did not name or give a list of all the co-conspirators (agents of the state) who may have helped the O'Connors. This Cretan's team pointed out that you should of at least provided their names: like give me the name of all the district clerks, all the sheriffs, all the judges names, etc. They also point out that none of the presently living agents were not provided citations like their "daddy" was. He may have gotten butt hurt because he was the only one who received a citation. They're basically calling the family's bluff...

Again, Cyborg's team insisted on the families' attorneys being technically accurate and follow the form of most plaintiffs' appeals. That is, get to the point and don't introduce historical reference or red herring arguments that don't have anything to do with the case. Do you see the futility of bring this to trial?
